Occupation is distinguished from possession as follows:

1. Occupation is a mode of acquiring ownership; possession is not;
2. The object of occupation are things which are without an owner; The object of possession are things with an owner.

Illegal and impossible conditions in a simple donation are considered as not imposed and does not affect the validity of the donation; Illegal and impossible conditions in an onerous donation make the donation void.
